PULSE TELCOM – TERMS OF SERVICE

Welcome to Pulse Telcom (“Pulse Telcom,” “Company,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of our telecommunications services, voice services, messaging services, SIP services, APIs, websites, software platforms, applications, and related services (collectively, the “Services”).
By using the Services, you agree to be bound by these Terms.
1. SERVICES
Pulse Telcom provides telecommunications-related services including, but not limited to:
- Voice services
- SIP trunking
- Messaging services
- DID provisioning
- Telecommunications routing
- Carrier services
- Hosted communications infrastructure
- APIs and software tools
Services may be modified, suspended, or discontinued at any time without liability.
2. ELIGIBILITY
You represent that:
- You are at least 18 years old
- You have authority to bind the entity using the Services
- All information provided is accurate
- Your use complies with all applicable laws and regulations
3. CUSTOMER RESPONSIBILITIES
Customers are solely responsible for:
- Obtaining all required consents
- Compliance with TCPA, TSR, FCC rules, DNC regulations, and all applicable laws
- Content transmitted through the Services
- Campaign compliance
- Maintaining account security
- Preventing unauthorized use
- Payment of all charges
Use of the Services for illegal, abusive, fraudulent, deceptive, or non-compliant activity is strictly prohibited.
4. CALLING AND MESSAGING COMPLIANCE
Customers must ensure all calls and messages comply with:
- TCPA
- TSR
- FCC regulations
- State telemarketing laws
- Do Not Call requirements
- Carrier policies
- STIR/SHAKEN requirements
- SMS compliance rules
Pulse Telcom reserves the right to suspend or terminate any campaign or account that generates complaints, traceback activity, carrier violations, or reputational harm.
5. PROHIBITED ACTIVITIES
You may not use the Services for:
- Illegal robocalling
- Spam
- Caller ID spoofing
- Fraudulent activity
- Scam campaigns
- Phishing
- Harassment
- Traffic pumping
- Artificial traffic generation
- Unauthorized prerecorded calls
- Transmission of malware
- Network abuse
- Circumvention of carrier policies
6. CARRIER AND NETWORK RIGHTS
Pulse Telcom may:
- Block traffic
- Suspend accounts
- Filter calls
- Reject campaigns
- Modify routing
- Investigate complaints
- Cooperate with traceback requests
- Share compliance data with carriers and regulators
without prior notice where necessary to protect network integrity.
7. BILLING AND PAYMENTS
All fees are due as invoiced.
Failure to pay may result in:
- Service suspension
- Termination
- Collections activity
- Additional fees
Fees are non-refundable unless otherwise stated.
8. INTELLECTUAL PROPERTY
All software, systems, branding, documentation, and infrastructure remain the property of Pulse Telcom or its licensors.
No ownership rights are transferred.
9. DISCLAIMER OF WARRANTIES
SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
PULSE TELCOM DISCLAIMS ALL WARRANTIES INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED SERVICE
- ERROR-FREE OPERATION
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE TELCOM SHALL NOT BE LIABLE FOR:
- INDIRECT DAMAGES
- LOST PROFITS
- BUSINESS INTERRUPTION
- LOST DATA
- CONSEQUENTIAL DAMAGES
- PUNITIVE DAMAGES
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID FOR SERVICES DURING THE PRIOR 30 DAYS.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Pulse Telcom and its affiliates from any claims arising from:
- Your use of the Services
- Regulatory violations
- TCPA claims
- Carrier complaints
- Spam allegations
- Consumer claims
- Illegal calling or messaging activity
12. TERMINATION
Pulse Telcom may suspend or terminate Services at any time for:
- Violations of these Terms
- Compliance concerns
- Carrier directives
- Fraud indicators
- Excessive complaints
- Payment failures
13. GOVERNING LAW
These Terms shall be governed by the laws of the State of California.

PULSE TELCOM – ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy governs all use of Pulse Telcom Services.
PROHIBITED USES
The following activities are prohibited:
- Illegal robocalling
- Calling without consent
- SMS spam
- Phishing
- Fraudulent campaigns
- IRS impersonation
- Government impersonation
- Tech support scams
- Traffic pumping
- Caller ID spoofing
- Neighbor spoofing
- Scam lead generation
- Unauthorized prerecorded calls
- Unlawful debt collection activity
- Harassment
- Malware distribution
- DDoS attacks
- SIP attacks
- Network abuse
COMPLIANCE REQUIREMENTS
Customers must maintain:
- Proof of consent
- Opt-in records
- Campaign records
- DNC compliance procedures
- Internal compliance processes
Records must be provided upon request.
TRACEBACK COOPERATION
Pulse Telcom cooperates with:
- Carriers
- Regulators
- Industry traceback groups
- Anti-fraud organizations
Customers must promptly respond to traceback and compliance inquiries.
ENFORCEMENT
Pulse Telcom may immediately suspend or terminate Services for violations.
No refunds will be provided for terminated accounts involving abuse or non-compliance.
PULSE TELCOM – TCPA & CONSENT POLICY
Effective Date: May 15, 2026
Customers using Pulse Telcom Services must comply with all applicable calling and messaging laws.
CUSTOMER RESPONSIBILITIES
Customers are solely responsible for:
- Obtaining valid consent
- Maintaining consent records
- Honoring revocations
- Maintaining DNC compliance
- Verifying lawful calling practices
CONSENT REQUIREMENTS
Customers using prerecorded calls, autodialing systems, or SMS campaigns must maintain legally sufficient consent records including:
- Date and time of consent
- Source URL or capture source
- IP address where applicable
- Consent language presented
- Consumer phone number
- Opt-in confirmation records
REVOCATION OF CONSENT
Customers must promptly honor:
- STOP requests
- Opt-outs
- Revocations of consent
- DNC requests
AUDITS
Pulse Telcom reserves the right to request proof of consent and suspend Services pending review.
PULSE TELCOM – SMS MESSAGING POLICY
Effective Date: May 15, 2026
This SMS Messaging Policy governs use of Pulse Telcom messaging Services.
MESSAGE FREQUENCY
Message frequency varies by campaign and customer interaction.
OPT-IN REQUIREMENTS
Customers must obtain express consent before sending SMS or MMS messages.
OPT-OUT
Recipients may opt out by replying:
STOP
After opting out, no further messages may be sent except legally permitted confirmations.
PROHIBITED SMS CONTENT
Prohibited content includes:
- Fraud
- Spam
- Phishing
- Illegal offers
- SHAFT content where prohibited
- Deceptive claims
- Unauthorized marketing
CARRIER ENFORCEMENT
Carriers may:
- Block traffic
- Filter messages
- Suspend campaigns
- Audit compliance
Pulse Telcom is not responsible for carrier filtering decisions.
PULSE TELCOM – CARRIER COMPLIANCE STATEMENT

Pulse Telcom is committed to maintaining lawful, transparent, and compliant telecommunications operations.
We actively work to:
- Mitigate illegal traffic
- Prevent spam and fraud
- Support traceback efforts
- Implement STIR/SHAKEN protocols
- Maintain carrier compliance standards
- Investigate abuse complaints
- Protect network integrity
Pulse Telcom reserves the right to suspend or terminate traffic that may negatively impact carriers, consumers, or the telecommunications ecosystem.
PULSE TELCOM – STIR/SHAKEN COMPLIANCE STATEMENT
Effective Date: May 15, 2026
Pulse Telcom supports industry efforts to combat illegal caller ID spoofing through STIR/SHAKEN implementation and related call authentication standards.
We may:
- Authenticate outbound traffic
- Evaluate attestation eligibility
- Block suspicious traffic
- Cooperate with traceback requests
- Require customer verification
- Monitor call patterns for abuse
Attestation levels are assigned based on available information and regulatory requirements.
Pulse Telcom reserves the right to refuse authentication for traffic deemed suspicious, unverifiable, or non-compliant.
PULSE TELCOM – LAW ENFORCEMENT REQUEST POLICY
Effective Date: May 15, 2026
Pulse Telcom may disclose customer information when required by:
- Lawful subpoena
- Court order
- Regulatory request
- Emergency disclosure request
- Law enforcement investigation

Pulse Telcom reserves the right to object to overbroad or improper requests where appropriate.
PULSE TELCOM – CPNI POLICY
Effective Date: May 15, 2026
Pulse Telcom respects the confidentiality of Customer Proprietary Network Information (“CPNI”) as required by applicable law.
CPNI may include:
- Calling records
- Service usage information
- Billing details
- Service configuration information
Pulse Telcom uses commercially reasonable safeguards to protect CPNI from unauthorized access or disclosure.
CPNI may be disclosed where permitted or required by law.
PULSE TELCOM – DMCA POLICY
Effective Date: May 15, 2026
If you believe content hosted or transmitted through Pulse Telcom Services infringes your copyright, submit a DMCA notice to:

Your notice must include:
- Identification of the copyrighted work
- Identification of the allegedly infringing material
- Your contact information
- A statement under penalty of perjury that the complaint is accurate
